Terms of Service

Canarionet, operated by Bostjan Biber, is an online directory, networking, and advertising platform that provides informational visibility for companies, services, and opportunity offers. The platform is a technical intermediary only and does not itself provide, execute, supervise, or guarantee third-party services, job offers, freelance opportunities, collaborations, or related outcomes.

To register and use the platform you must be at least 14 years old and have the legal capacity to enter into a binding agreement. If you use the platform on behalf of a company or organisation, you represent that you are authorised to bind that entity. We may suspend or close accounts created with false information or by ineligible persons.

Each provider is solely responsible for its listings, opportunity offers, claims, prices, legal compliance, and service quality. The platform may review, prioritize, suspend, or remove content for policy, quality, or legal reasons — including through an automated AI review system — but is under no obligation to pre-screen or continuously monitor all content. Publication does not imply endorsement, certification, legal verification, suitability, or guarantee by the platform. If your content is automatically rejected or hidden, you may request a human review — see our Privacy Policy for how.

User-provider interactions may occur through platform tools or direct contact data. Any service, employment, freelance, collaboration, purchase, or other contract is exclusively between the relevant parties. The platform is not an employer, recruitment agency, placement agency, contractor, broker, reseller, or representative of providers or users, and is not a party to those agreements.

You may post a request describing what you need. Registered businesses may answer with a private offer. Canarionet puts the parties in touch but is not a party to any agreement between them and takes no part in performing it.

There is no acceptance mechanism, basket, order or payment between the parties on the platform. An offer is pre-contractual information: any agreement is concluded outside Canarionet and under the sole responsibility of those concluding it.

Requests are reviewed before publication. You may correct a rejected request a limited number of times and, once that allowance is spent, ask for a person to review the decision. Every decision is communicated to you in writing, with its reason.

If paid platform features are offered, billing terms are shown before purchase and apply only to fees charged by the platform itself. Refund eligibility for platform fees follows the Refunds page and mandatory consumer law. Payments, deposits, advances, disputes, delays, non-performance, or damages relating to third-party providers are outside the platform's contractual responsibility and must be resolved directly with the relevant provider.

Vouchers, promotional codes and complimentary entitlements are granted at the platform's discretion to a named organisation or person and for a specific purpose. They are personal to the recipient, non-transferable, carry no cash value, and may not be sold, published, resold or otherwise shared. Unless stated otherwise when the voucher is granted, it may be limited in validity period, in the number of redemptions, and in the plans and features to which it applies.

Redeeming a voucher that was not granted to you, or that was obtained without authorisation or by circumventing a restriction on its use, is a breach of these terms. Where that occurs we may withdraw the discount and charge the standard price for the plan from the date the unauthorised benefit began, cancel the subscription carrying that benefit, and invoice the amount that was not charged because of it.

Where a voucher allowed an account to be opened without payment details, we may require valid payment details before the subscription continues. Withdrawal of a voucher does not by itself close the account: the organisation may continue on a plan it pays for, or on the free plan, subject to that plan's limits. We will give reasonable prior notice before withdrawing a benefit, except where the voucher was obtained fraudulently or its use presents a security or legal risk.

The platform, software, design, and original content are protected by intellectual property laws. By submitting content, users and providers represent they hold all required rights and grant the platform a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt for technical formats, and display such content for operating, promoting, and securing the service. Submitters remain liable for any infringement or unlawful content and shall indemnify the platform where legally permitted.

Posters, cards and stickers generated with the platform's QR studio ("QR designs") are licensed to the generating organisation, not sold. While the organisation's account remains active it may reproduce and display its QR designs for its own business, in print and on merchandise, at no additional cost. On plans that include branding removal, copies may be produced without the CanarioNet credit for as long as such a plan remains active.

If the account or the paid plan ends, material already produced may continue to be used; any new copies produced thereafter must retain the CanarioNet credit unaltered.

The templates, decorative motifs and the seven-island signature mark remain the intellectual property of the platform and may not be extracted, traced, imitated or used outside QR designs generated with the studio. Every QR design carries the seven-island signature so that its origin remains identifiable. The QR code itself, and the destination it encodes, belong to the organisation.

We provide the platform on an "as is" and "as available" basis. Canarionet is an early-stage, growing service: we use commercially reasonable efforts to keep it available, accurate, and supported, but we do not guarantee uninterrupted or error-free access, any ranking position, conversion, lead volume, business outcome, or fitness for a particular purpose, and you should not rely on it as your sole system of record. We may modify, limit, suspend, or permanently discontinue the platform or any feature, in whole or in part, at any time. If we discontinue or materially reduce a paid feature you have purchased, we will, where practicable, give you reasonable prior notice, let you export your content, and refund the unused, prepaid portion of your fees on a pro-rata basis (see the Refunds page). To the maximum extent permitted by law, we are not liable for indirect, consequential, special, reputational, profit, revenue, goodwill, opportunity, business-interruption, or data losses, including any arising from the modification, suspension, discontinuation, or unavailability of the platform, or from third-party listings, negotiations, or contracts; and our total aggregate liability for any claim relating to the platform is limited to the platform fees you paid us in the twelve (12) months before the event giving rise to the claim. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including mandatory consumer-protection rights and liability for fraud, gross negligence, or wilful misconduct. Planned maintenance will be communicated when reasonably possible.

You may close your account at any time from your account settings or by contacting us. We may suspend or terminate your account, with reasonable prior notice where practicable, if you breach these terms, use the platform unlawfully, or where required by law; in cases of serious breach, fraud, security risk, or legal obligation we may act without prior notice. On closure, your personal data is handled as described in the Privacy Policy and the Data Deletion page. Provisions that by their nature should survive termination (such as intellectual property, liability, and governing law) remain in force.

Section 9 covers changes to individual features. This section is different: it is what we commit to if we close the platform as a whole. If we decide to discontinue Canarionet permanently, we will give you at least 90 days' notice before the closing date, by email and inside the platform. During that period we will stop accepting new subscriptions, stop charging renewals, and refund the unused, prepaid part of any active subscription on a pro-rata basis, as set out on the Refunds page. We may act on shorter notice only where insolvency, a court order, or the law prevents us from honouring this period.

Throughout the notice period you can export your data from your account settings, free of charge and as often as you wish. The export covers your listings and content, your menus and catalogues, your website configuration, your uploaded media, your billing and invoicing records and, where applicable, your Tagoror space data. At least 60 days before the closing date we will also generate a complete copy for you and email you a download link, so you do not have to be watching for it. Exports are available up to the closing date and not after it: on that date your data is deleted, except for records we are required by law to keep — billing and tax records, retained for 6 years as described in the Privacy Policy.

Your links do not die with the service. Before the closing date you can set a forwarding address for your Canarionet subdomain and for each of your menu QR codes. For at least 12 months after the closing date we keep the canarionet.com domain running as a redirect service, so that your subdomain and any QR code you have already printed keep leading your customers to you. Where you have not set a forwarding address, we serve a frozen copy of your published menu instead of an error, so that printed material keeps working. If you have connected your own domain, point its DNS to your new provider before the closing date; we will forward it in the meantime, but we cannot do so indefinitely.

We pay for the redirect service in advance so that it survives the closing of the business. Beyond the period stated above we do not guarantee it, and we do not guarantee any business result arising from it. The liability limits in section 9 apply to this section as well.

We may update these terms to reflect changes to the service, the law, or our business. We will publish the updated version on this page with a new 'last updated' date and, for material changes, give reasonable prior notice through the platform or by email. Continued use of the platform after the changes take effect constitutes acceptance. If you do not agree to the changes, you may stop using the platform and close your account.

These terms are governed by Spanish law, without prejudice to the mandatory consumer-protection rules and mandatory jurisdiction that apply where you are habitually resident; as a consumer, you may bring proceedings before the courts of your place of residence. If a provision is held invalid, the remaining provisions remain in force. Under EU Regulation 524/2013, consumers may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
